PUBLICATION –

WILL AND CLAIMS

 

Notice is given of the death of Charles E. DeClerck.  Letters of office were issued on May 17, 2022, to Thomas E. DeClerck, 1863 N. 1800 E. Rd., Stonington, Illinois 62567, and Janet C. DeClerck, 1851 N. 1400 East Road, Taylorville, Illinois 62568, as Independent Co-Executors, whose attorney is Samuels, Miller, Schroeder, Jackson & Sly, LLP, 225 N. Water St., Suite 301, Decatur, IL 62523.

 

Notice is given to unknown heirs-at-law of Charles E. DeClerck that a petition was filed in the above proceeding to probate a will and that an Order was entered by the Court on May 17, 2022, admitting the will of Charles E. DeClerck to probate.  Within 42 days after the effective date of the original Order of admission you may file a petition with the Court to require proof of the will by testimony of the witnesses to the will in open court or other evidence, as provided in Section 5/6-21 of the Probate Act (755 ILCS 5/6-21).  You also have the right under Section 5/8-1 of the Probate Act (755 ILCS 5/8-1) to contest the validity of the will by filing a petition with the Court within 6 months after admission of the will to probate.

 

The estate will be administered without Court supervision unless, under Section 5/28-4 of the Probate Act (755 ILCS 5/28-4), any interested person terminates independent administration at any time by mailing or delivering a petition to terminate to the Clerk of this Court.

 

Claims against the estate may be filed in the Office of the Clerk of the Court at 101 S. Main Street, Taylorville, Illinois 62568, or with the representative, or both, on or before November 28, 2022, as to any creditor notified by publication of this Notice, or, on or before three months from the date of mailing or delivery of this Notice to a creditor, whichever is later.  Any claim not filed on or before that date is barred.  Copies of a claim filed with the Clerk must be mailed or delivered to the representative and to the attorney within 10 days after it has been filed.
